Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TALK2.NOW website, applications, and services (the "Platform"). The Platform is operated by RUMATECHNOLOGIES (PTY) LTD ("TALK2", "we", "us", or "our"), a company registered and operating in South Africa.

By creating an account, browsing the site, purchasing a session, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

TALK2.NOW is an intermediary marketplace that connects users ("Buyers") with celebrities, creators, experts, and mentors ("Personalities"). We facilitate bookings for three primary service types:

• TALK2 ME: Private, one-on-one real-time video calls.
• TALK2 LIVE: Interactive, real-time online group video events.
• TALK2 MEET: Scheduled, in-person events hosted by a Personality.

TALK2 is strictly a video-first platform. We do not offer or support audio-only sessions. A working camera and microphone are required to participate in any TALK2 ME or TALK2 LIVE session.

Intermediary Status

TALK2 acts solely as an intermediary. Personalities are independent individuals or entities, not employees, agents, or representatives of TALK2. Personalities set their own prices, availability, and event formats. TALK2 does not direct or control the content of any session and makes no representations or guarantees regarding the accuracy, quality, or outcomes of any conversation. No professional, medical, legal, or financial advice provided by a Personality is endorsed by TALK2.

You must be at least 18 years old to create an account or make a purchase on the Platform.

You may only register one account per person. You are entirely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. TALK2 reserves the right to suspend or terminate accounts that breach these Terms or engage in fraudulent activity.

All transactions on the Platform are processed in South African Rands (ZAR) via our designated payment gateway, PayFast.

• Creation of Bookings: A booking or ticket is only confirmed and created once the payment has been successfully verified by PayFast's server-to-server notification. A session cannot be initiated from the browser until this confirmation occurs.
• Minimum Prices: To cover gateway costs and real-time infrastructure, TALK2 enforces minimum base prices for all services depending on their type and duration.
• Platform Fee: TALK2 retains a platform service fee of 20% (which includes all PayFast gateway processing costs) from every transaction. The Personality receives the remaining 80% net share of the session price.
• Payouts to Personalities: Accrued earnings are currently settled and paid out to Personalities manually by TALK2. We do not provide automated or instant payouts.

Refund eligibility is strictly governed by the state of the session and is processed as follows:

TALK2 ME (1:1 Calls)

A Buyer is entitled to a full refund of their TALK2 ME payment ONLY if:

• The Personality explicitly declines the incoming request.
• The request is cancelled by either party before the call has officially started.
• The request is not answered. If a Personality does not accept a requested call within 15 minutes, it is automatically declined and flagged for a refund.

Once both parties have entered the room and the paid countdown has begun, no automatic refunds will be issued.

TALK2 LIVE and TALK2 MEET (Events)

If a scheduled event is cancelled by the host or the platform prior to completion, all valid tickets purchased for that event will be flagged for a refund. Buyer no-shows, late arrivals, or failure to meet venue requirements (for in-person events) are not refundable.

Refund Processing

All refunds are reviewed and executed manually by TALK2 staff via PayFast. Refunds are not instantaneous and may take several business days to reflect in your account once approved.

When participating in group or in-person events, the following systemic rules apply:

• TALK2 LIVE limits: Live online events are hard-capped at a maximum duration of 60 minutes. Free events are restricted to 30 minutes and a maximum of 50 attendees. Paid events may host up to 200 attendees.
• Registration Deadlines: Hosts may configure ticket sales to close ahead of an event's start time.
• Auto-cancellation: A scheduled TALK2 LIVE event that is not started by the host within 15 minutes of its scheduled start time will be automatically cancelled, and tickets flagged for refund.
• TALK2 MEET restrictions: In-person events are paid-only and seat capacities are strictly limited. Entry may be subject to specific requirements set by the host (such as minimum age or dress code), which must be adhered to.

Real-time video on the Platform is delivered using ZEGOCLOUD. TALK2 does not record, monitor, or store the audio/video streams of calls or live events.

No Unauthorized Recording: You may not record, screen-capture, broadcast, or redistribute any session, event, or the likeness of another participant without their explicit prior consent.

Prohibited Conduct

You agree not to use the Platform to:

• Harass, abuse, threaten, or defame any Personality or User.
• Transmit hate speech, discriminatory content, or sexual content involving minors.
• Engage in any illegal or fraudulent activity.
• Impersonate any person or entity.
• Circumvent platform fees (e.g., by using the Platform to make contact but taking the paid session off-platform).
• Scrape, datamine, or attack the technical infrastructure of the Platform.

Reviews

Only Buyers who have completed a verified, paid session may leave a review. You are limited to one review per purchase. Reviews must be honest and reflect your genuine experience. TALK2 reserves the right to remove reviews that are unlawful, abusive, or demonstrably fraudulent.

TALK2 owns the Platform, its underlying code, design, features, and the TALK2 trademarks and logos. You may not copy or use our branding without permission.

Personalities retain full ownership of their own profile photos, intro videos, and any text they upload. However, by uploading content to the Platform, Personalities grant TALK2 a non-exclusive, worldwide, royalty-free licence to host, display, format, and promote that content on and for the Platform. You represent and warrant that you own or have the necessary rights to any content you upload.

THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TALK2 DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TALK2 is not liable for the conduct, statements, or actions of any Personality or Buyer during a session or in-person event.

To the maximum extent permitted by South African law, TALK2 and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of or inability to use the Platform. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to TALK2 (excluding amounts passed on to Personalities) in the six months preceding the claim.

You agree to indemnify and hold harmless TALK2 from any claims, damages, or expenses arising from your breach of these Terms or your conduct on the Platform.

Governing Law: These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the Republic of South Africa.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

Changes to the Terms: We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date on this page and/or sending an email notification. Your continued use of the Platform constitutes acceptance of the new Terms.
